The Mysterious "12A" Set of CC&Rs for The Fairways

Every once in a while, the topic of an alternative set of Declaration of Protective Covenants (Covenants, Conditions and Restrictions or "CC&Rs") comes up for The Fairways at Fieldcreek Ranch. This set of CC&Rs is labeled "FIELDCREEK RANCH UNIT 12A", as opposed to the familiar "FIELDCREEK UNIT 12A AND 12B" document that we all know and love (or perhaps hate in some exceptions).



The "12A" document contains a blank space for the date of the declaration. We believe that this was most likely a preliminary copy that was given to early prospective lot buyers in 2000 when the community was being developed, as we have neither seen a copy of it with the date of declaration actually written on it nor ever found a recorded version of that document.


The active "12A AND 12B" CC&Rs document is dated 09/20/2000 and was recorded the next day on 09/21/2000 as document #2484366 with the Washoe County Recorder. This document has been confirmed by the association's general counsel as the only set of valid CC&Rs for The Fairways at Fieldcreek Ranch.


The earliest recorded date of sale that we can find of any developed lot within The Fairways is also on 09/21/2000, and all lots within Fieldcreek Ranch Units 12A and 12B are thus subject to those CC&Rs.
